Arkansas Long-Term Disability Lawyers

With disability insurance lawyers serving Arkansas, Dabdoub Law Firm can help you get the long-term disability benefits you deserve.

Many employers in Arkansas offer group long-term disability insurance coverage to their employees. Unfortunately, insurance companies do not always live up to their promise to pay disability benefits and deny or delay valid disability claims.

Dabdoub Law Firm was built to be a disability insurance law firm. Because all our disability lawyers focus on disability insurance claims, the firm has significant experience with every major disability insurance company and has won important disability lawsuits.

How Disability Insurance in Arkansas Works

Disability insurance policies pay benefits for a period of time if you are unable to work in your occupation. Your occupation means the job you were working in at the time you became disabled. Most group disability policies, those obtained through your job, will pay for 24 months if you cannot work in your own occupation. After this time period, you must show you are unable to work in any occupation in order to keep receiving benefits. Based on our law firm’s experience, most disability insurance claims are terminated after 24 months.

Arkansas Disability Law

Most disability insurance claims and lawsuits in Arkansas are governed by a federal statute known as ERISA. Before filing a lawsuit for disability benefits, the law might require you appeal the denial of your disability claim to the insurance company. If the appeal is denied, then you have a right under the law.

Arkansas Courts for Disability Insurance Cases

Arkansas has a federal district court, which requires any appeals of decisions to be decided by the Eighth Circuit Court of Appeals. There are several ERISA disability cases that have been decided in the Eighth Circuit, which affects Arkansas disability claims.

In Brake v. Hutchinson Tech. In. Grp. Disability Income Ins. Plan, 774 F. 3d 1193 (8th Cir. 2014), the Eight Circuit held that Minnesota law applied to a case brought by a South Dakota resident. This was because the disability policy in question was issued in Minnesota to a Minnesota employer, and had a choice of law provision stating it was governed by Minnesota law.

Although ERISA is a federal law, any governing state law is important when it comes to how a court decides a long-term disability case. This case is an example of a court applying law from another state in an ERISA case.
