Details of the PTSD Denial Case
Our client suffers from and has been diagnosed with post-traumatic stress disorder (PTSD), major depressive disorder (MDD), and generalized anxiety disorder (GAD). Each of these medical conditions cause a serious concern for his overall mental health, not to mention the harm caused by all three being concurrent. For years, our client’s treating doctor and psychotherapist concluded he was “lost to treatment” and noted the gradual worsening of his conditions. It was determined by the two of them that he was no longer fit to continue his work as a mechanical engineer.
In order to pursue treatment to the full extent of its usefulness, our client left work and filed for long term disability benefits. During his continued treatment, our client exhibited numerous signs of mental disconnections due to his disorders, including social isolation, bouts of confused stupors, insomnia, manic pacing, flashback triggers, and more. Despite all of these persistent symptoms and day-to-day complications, Liberty denied his claim to long term disability benefits.
We went right to work to determine why his claim was denied. As it was uncovered, Liberty used the opinion of a single physician who never met or treated our client to push its denial forward. In doing so, it flatly ignores the extensive care and work of both of our client’s treating specialists.
