On April 24, 2020, Lincoln Life Assurance Company of Boston (Lincoln) denied an emergency room doctor’s request for leave under the Family and Medical Leave Act (FMLA) because he “did not submit and/or complete the required documents.” The doctor was only missing one (1) form and had recently been diagnosed with prostate cancer.
Upon this denied request, our Wilton, Connecticut-based client sought assistance from Dabdoub Law Firm. We were not only able to get his FMLA leave approved, but we also requested short-term disability (STD) benefits on his behalf.
Details of the ER Doctor’s Case
After being diagnosed with prostate cancer, our client realized he needed to take a step back from work and put his health first. He submitted a request for FMLA leave to Lincoln, so he could comfortably focus on his health for the first time in over 3 decades.
