Our client suffered a serious fall while in the Dominican Republic in July 2018. He lost consciousness for about 24 hours and was admitted to the intensive care unit (ICU). When he returned home to Miami, Florida, our client attempted to resume his practice of urology. Unfortunately, he was no longer able to practice safely, due to complications and cognitive decline. Our client was diagnosed with a traumatic brain injury and had his privileges suspended because he posed “an immediate risk of substantial harm to the health or safety of patients.”
A neuropsychological exam revealed that our client’s intellectual functioning had decreased dramatically to the “low average to average range,” which is unacceptable for a physician. According to his suspension, our client was frequently tardy, failed to complete cases, and made mistakes when dictating information and even marking surgical sites.
Because our client was unable to function at the level required of his profession, he was deemed unable to work. Sadly, he also struggled with alcoholism, despite several months in rehabilitation. Our client was admitted to a hospital on March 6, 2020. As of this date, UNUM had more than enough evidence to approve disability benefits.
