A transferable skills analysis (“TSA”) is a set of tests to determine what other kinds of occupations a person can perform based on their past work experience, work activities, language skills, education, and the like. Then the analyst determines what skills the person possesses that can be utilized in another occupation or job.
In a disability insurance claim, a TSA is used to determine what skills the person has that could be applied to a different type of job than the one from which they are claiming disability. However, this alone cannot support or refute a disability claim.
As attorneys who specialize in disability insurance, we understand that this analysis is only one piece of a bigger puzzle. Just because someone has transferable skills to another occupation, does not mean they are physically or mentally capable of working in any occupation.
Insurance companies are quick to deny claims based on these types of reports that claim to show a person is not disabled because they can perform other work. When appropriate, we work closely with the medical providers to clearly lay out the medically-supported restrictions and limitations. From there, we apply the restrictions and limitations to occupational duties. Ultimately, if a person cannot perform the basic requirements of a sedentary occupation, then they are disabled from working in any capacity.
