Attorney Burgos Appeals to NY Life on Our Cincinnati Client’s Behalf

Our client from Cincinnati used to work as a Sales Representative. Unfortunately, she had to stop working because of the debilitating symptoms caused by her diabetic neuropathy. Additionally, she is dealing with lumbar spondylosis, chronic pain syndrome, lumbar degenerative disc disease, and debility. The medical evidence has extensively documented her condition, which supports a finding of total disability not only from her previous job but even from a sedentary position.

NY Life’s Termination of Benefits Was “Wrong & Unreasonable”

Our client's LTD benefits were wrongly terminated by NY Life without any improvement in her medical condition. In addition, her WOLP claim was unjustly denied. To provide clarity regarding our client's functionality, she willingly underwent a functional capacity evaluation (FCE).

The comprehensive FCE report determined that our client has significantly decreased upper body (UB) and lower body (LB) strength. These limitations prevent her from working at the moment. The evaluation identified the following restrictions and limitations:

  • Sitting is limited to a maximum of 30 minutes at a time, totaling up to 2 hours per day.
  • Standing is limited to two minutes at a time for a total of 30 minutes. She requires upper extremity support on a table or wheelchair due to significant balance impairments.
  • She is unable to walk without a mobility device.

These physical restrictions and limitations make it impossible for our client to work full-time at any level of demand. Considering the inability to sit comfortably for at least six hours per day, it is evident that our client cannot reliably perform any full-time occupation, even sedentary ones.

After our client in Cincinnati had her LTD benefits terminated, Attorney Geannina A. Burgos, from Dabdoub Law Firm, worked tirelessly to compile a comprehensive collection of evidence in support of her ongoing disability. Following a meticulous review of the substantial evidence pertaining to our client's disability, NY Life approved her claim for long-term disability benefits.
