Dabdoub Law Firm Restores Hartford LTD Benefits for San Antonio Client
In October 2022, Dabdoub Law Firm successfully appealed to Hartford on behalf of our client in San Antonio. After her insurer wrongfully denied her claim for long-term disability (LTD) benefits, this disabled Texas resident turned to our experienced disability insurance attorneys for assistance. Attorney Schaefer Restores LTD Benefits for Texas Client with Parkinson’s
After over 25 successful years working at Allstate, our San Antonio client was forced to set her hard-earned career aside she was diagnosed with Parkinson’s disease, a progressive neurological disorder that has resulted in a range of severe symptoms, including dyskinesia, fatigue, weakness, balance impairments, fine motor skill deficits, tremors, and anxiety.
As one can imagine, these symptoms made it impossible for our client to continue working in her longstanding occupation as a claims technician. Nonetheless, Hartford saw fit to wrongfully deny our Texas client the disability benefits she rightfully deserves.
Dabdoub attorney Kevin Schaefer came to his client’s defense, firmly reminding Hartford of their obligations under ERISA law and pointing out that his client’s conditions “have not magically dissipated.”
“The objective evidence overwhelmingly confirms that [my client] remains disabled and unable to work,” Attorney Schaefer reminds Hartford in a letter. “Somehow Hartford suggests Ms. X completely recovered from Parkinson's and is no longer restricted in any manner. The evidence and common sense dictate otherwise.”
By choosing to rely on paper-based reviews rather than a legitimate in-person medical examination, Hartford deprived our client of the LTD benefits she rightfully deserves. “Updated medical records refute Hartford’s meritless suggestion that Ms. X is all better,” Attorney Schaefer confirms, adding that his client underwent a functional capacity evaluation (FCE) in early 2023 to supplement the already-sufficient medical evidence of her disability. The medical specialist concluded that she “is not capable of working at any full-time job, even at the sedentary level.”
“Updated medical records refute Hartford’s meritless suggestion that [my client] is all better,” Attorney Schaefer concludes, adding that the Texas resident continues to seek treatment from numerous medical specialists. This includes her neurologist, who has since confirmed that our San Antonio client suffers from “leg tremors, fatigue, brain fog, dizziness, and difficulty with grip.”
The wealth of medical evidence is accompanied by personal letters of support from our client’s friends and family. Her sister, a registered nurse, describes her as “determined, prideful, and strong.” However, our client’s condition reached a point where she couldn’t even drive, pump her own gas, or make her own food due to the effects of Parkinson’s.
Fortunately, our experienced attorneys at Dabdoub Law Firm successfully appealed to Hartford to restore our client’s long-term disability benefits, providing her with the support she deserves during this difficult season.
