Our Disability Lawyers Successfully Appealed to Hartford on Our Florida Client’s Behalf
After Hartford terminated his disability benefits without cause in December 2021, a frustrated Orlando resident turned to our experienced disability insurance attorneys for assistance. Despite providing substantial evidence of his disability, his insurer refused to approve his claim under the guise of an inaccurate medical report—one they claimed was reviewed by two physicians, but was actually reviewed by one for the sake of denying our client’s claim.
Even so, Hartford’s in-house specialist confirmed overwhelming evidence of our client’s disability in her report, including:
- Severe pulmonary hypertension
- Coronary artery disease
- Rapid atrial fibrillation
- Shortness of breath
- Moderate-to-severe mitral regurgitation
- Mild tricuspid regurgitation
- Chronic kidney disease
- Multiple surgeries and procedures
- Cervical myelopathy
- Bilateral paresthesia of his hands
- Chronic chest, neck, and back pain
As if the above list isn’t enough to prove his disability, our Orlando client also underwent a functional capacity evaluation (FCE) to put Hartford’s unwarranted doubts to rest.
“Based on the results of the FCE, [my client] does not meet the physical demand requirements of consistent and reliable, full-time work at any level,” says Attorney Kevin Probst, one of our experienced Dabdoub disability lawyers. “Surely, given the additional medical backdrop and a better understanding of [his] physical restrictions and limitations, Hartford does not still believe that he is capable of performing full-time work on a reliable and consistent basis?”
He goes on to remind Hartford of their ethical and legal duties under ERISA law, informing the insurer that they have a duty to act solely in the interest of their beneficiaries—something they clearly did not do in the case of our Orlando client. “Termination of benefits was largely based on Dr. Niebruegge’s review of [my client’s] incomplete medical records,” Attorney Probst adds. “But even Dr. Niebruegge’s review of the records he had at the time is inconsistent and contradictory.”
