Dabdoub Law Firm Secures LTD Benefits for ATX Client
In July 2022, Dabdoub Law Firm successfully appealed to Lincoln National Life Insurance on behalf of our client in Austin, TX after the insurance company wrongfully terminated her long-term disability (LTD) benefits.
Despite suffering from a myriad of debilitating symptoms and obtaining confirmation of her disabled condition from numerous physicians, Lincoln still saw fit to unjustly and unreasonably terminate our Texas client’s disability benefits without cause.
Fortunately, our experienced disability insurance lawyers successfully appealed to Lincoln National Life Insurance on her behalf. Keep reading to learn how our firm restored our Texas client’s long-term disability benefits and secured the continued support and care she rightfully deserves.
Our Disability Lawyers Appealed to Lincoln on Texas Client’s Behalf
Due to prolonged physical and sexual abuse in childhood and past instances of workplace abuse, our Austin client suffers from complex post-traumatic stress disorder (CPTSD).
“Complex” can’t be stressed enough. Like many survivors of childhood abuse and trauma, our client also struggles with anxiety, major depressive disorder, body/gender dysphoria, chronic back pain, and personality disorder symptoms.
Lincoln approved her claim for STD benefits and eventually LTD benefits while she continued aggressive treatment for PTSD, including ketamine infusions, weekly therapy, and multiple medications. Our client managed to return to work after reasonable accommodations were met.
However, when her PTSD symptoms exacerbated again, forcing her to withdraw from her occupation completely. Although our client has been unable to return to work since April 2021, Lincoln made the poor and unjust decision to deny her claim for continued benefits.
Lincoln Wrongfully Terminated Our Texas Client’s LTD Benefits
In its failure to conduct a proper and comprehensive examination of her disabling condition, Lincoln wrongfully denied our Texas client. This largely stemmed from a flawed peer review from the insurance company’s physician, which deemphasized her disabling condition and demonstrated a “disturbing pattern” of ignoring valid medical and non-medical evidence.
This disreputable report forced our client to endure more undue suffering as she continued to struggle with a constellation of crippling symptoms, including sleep disturbances, panic attacks, cognitive impairments in verbal expression, emotional dysregulation, and many others.
Fortunately, our accomplished disability attorneys were quick to point out the various holes in Lincoln’s callous decision. By reiterating and supplementing the already-extensive evidence against the insurance company’s denial, Dabdoub Law Firm successfully overturned this wrongful decision and restored the support our Austin client rightfully deserves after decades of suffering.
