Hartford LTD Benefits Successfully Appealed for Amazon Worker with Fibromyalgia in California

In June, a former Amazon worker in California with fibromyalgia had no choice but to turn to Dabdoub Law Firm for help after Hartford wrongfully denied him the long-term disability (LTD) benefits he deserved. Keep reading to learn more about this recent success in Modesto, CA.

Former Amazon Worker Denied LTD Benefits After Warehouse Accident

After a workplace accident damaged his foot at the Amazon warehouse in 2019, our California client struggled to manage the fallout, undergoing multiple corrective surgeries in hopes of improving his health and reestablishing his economic security—something he never deserved to lose in the first place.

Indeed, his coworker even recalls that prior to getting injured, our Modesto client “was just a few months away” from getting promoted at Amazon. Sadly, even multiple corrective surgeries yielded little improvement, failing to resolve our client’s chronic pain and rendering him unable to return to work within the timeframe he had initially hoped for.

Left with no choice but to abandon his hard-earned career, our client filed for LTD benefits through Hartford, who ultimately approved his claim. He turned to DoorDash to financially support his family in the meantime, but found himself unable to perform his job duties for longer than a few hours due to debilitating symptoms.

His physician clarified that “it is unlikely the claimant will improve significantly in his prognosis,” adding that his patient's complex regional pain syndrome (CRPS) diagnosis “is permanent.” This prognosis was further confirmed by numerous specialists.

Even after being diagnosed with fibromyalgia, CRPS, and chronic fatigue syndrome (ME/CFS) by his treating rheumatologist, Hartford saw fit to terminate our client’s disability benefits two years later, despite extensive medical evidence of our client’s disability.

Attorney Quirino Successfully Appeals on Behalf of California Client

Fortunately, our Dabdoub disability insurance lawyers wasted no time demanding justice for our California client, pointing to the wealth of clinical evidence in his favor.

Attorney Emily Quirino points out that Hartford “relied on the flawed medical examination” from its in-house doctor, who “unreasonably opined” that our client was capable of completing 10- to 12-hour workdays without issue—an absurd conclusion given the extensive evidence of our client’s deteriorating health and “permanent” diagnoses.

“Hartford’s doctor is unable to comment on [my client’s] conditions of fibromyalgia and chronic fatigue syndrome because of his occupational medicine background,” Attorney Quirino says in her appeal. “[He] has provided substantial evidence of disability. We are confident that given a second, good faith look, [his] continued entitlement to disability benefits will be clear.”

Luckily, our Dabdoub attorneys successfully reinstated the LTD benefits that our client deserved, allowing him and his family to regain the financial health they never deserved to lose in the first place.
