Details of Our Client’s Career & Diagnoses
Our client was diagnosed with multiple sclerosis (MS) in 2003 but was committed to building an impressive career for herself. She began work as a senior strategy director in 2007 and loved her work, which encouraged her to continue despite her chronic health condition. However, in 2018, she suffered serious heart complications that required mitral valve repair and a cryo-maze procedure. For a while, she tried to keep working, but mounting health problems like hypertension and chronic fatigue made it unsafe to work full-time.
In January 2022, she filed a partial disability claim with Lincoln, which was approved several months later. Not even one year passed before the insurance company abruptly canceled her benefits while citing a lack of information in her medical records about her restrictions.
In her first appeal to Lincoln, our client submitted notes from her medical team that stated her “health is poor overall, and working more than 20 hours per week will worsen her symptoms.” Another note would explain that she should “stop working permanently, effective immediately, due to the progression of her pulmonary hypertension.” Still, Lincoln said the medical evidence was lacking, and upheld the denial.
