Details of Our Client’s Disability
Our client (who will remain anonymous for privacy and confidentiality) is now 76 years old and living with comorbid medical conditions that make it difficult for him to take care of himself. He has also been described by medical experts as a “fall risk patient,” meaning his medical conditions put him at a constant risk of instability and falling over, which could result in a severe or life-threatening injury.

In 2022, Dr. Erica Dewitt, who evaluated and treated our client, concluded: “[The client] would benefit from significant professional care on a daily basis. He would be well served with the use of a cane. He lives alone and needs another eye. His medical professionals feel he no longer shoulder operate a motor vehicle as there is a possibility of a cardiac event or hypoglycemic event while on insulin that could occur during driving.” Shortly after, Dr. Rodolfo Alfonso also concluded that our client would need “palliative care” and Dr. Dewitt further concluded that he “requires long-term care.”
Mutual of Omaha Wrongfully Denies the Claim
Our client purchased a comprehensive long-term care insurance policy from Mutual of Omaha in 2012. This policy stated that it would provide him with monthly benefits if he became “chronically ill” and required “substantial assistance” to complete “at least two” day-to-day activities. Even though the medical evidence shows that our client needs daily care and suffers from multiple chronic conditions, the insurance company chose to deny his claim.
