Although these benefits were initially provided by The Lincoln National Life Insurance Company (Lincoln), the company revoked them two years later, so Ms. X turned to us for help.
Ms. X worked as a vice president of a software company until August 12, 2021. She was diagnosed with Stage 3 chronic kidney disease (CKD), and suffers from systemic lupus erythematosus (SLE), migraines, scleroderma, cognitive impairment, autoimmune disuse, and a variety of other disabling conditions.
As a result of her disabled condition, Ms. X stopped working and filed claims for long-term disability (LTD) benefits and a waiver of premiums with continued life coverage. At the time, Lincoln reviewed Ms. X’s medical records that supported the finding that she is totally disabled and approved her claims for LTD benefits and the life insurance premium waiver. Despite this initial determination and the evidence provided by medical experts, Lincoln reversed its decisions and revoked Ms. X’s benefits in August 2023.
‘Less-Than-Sedentary Capacity’
In February 2022, Ms. X submitted to an independent Functional Capacity Evaluation (FCE) that revealed her physical ability to work was at a “less-than-sedentary capacity.” Because the demands of Ms. X’s profession required her to work at a sedentary level, her condition’s lack of improvement indicated that she is totally disabled and unable to work even in a sedentary job.
Two months after Lincoln denied Ms. X’s claims, she underwent an independent Cognitive Functional Assessment (CFA) performed by clinical psychologist Bahareh Talei, Psy.D. Dr. Talei’s assessment of Ms. X’s condition concluded that she has “… severe cognitive deficits attributed to her conditions. The patient’s evaluation revealed impairments across several cognitive domains including memory, processing speed, attention, concentration, and executive functions.” Dr. Talei also noted that Ms. X’s documented cognitive would “severely interfere” with her ability to perform her previous role or any similar occupation, and that she “does not possess the required cognitive capacity for work at this time.”
