Dabdoub Law Firm has the resources, experience, and litigative stamina to spar repeatedly with major insurance companies if that’s what is needed to win for a client in need. Recently, Attorney Geannina Burgos successfully challenged Lincoln National Life Insurance Company (Lincoln) after it prematurely terminated our client’s long-term disability benefits—a decision that occurred after our legal team had already successfully appealed the initial wrongful denial of those same benefits. While we are satisfied that our client once again has the benefits he needs due to chronic pain that stopped his career at a young age, we know to stay vigilant in case Lincoln tries to cut our client’s benefits short again.
Details of the Sparring Case with Lincoln
Our client is a young software engineer who once had his whole career ahead of him. However, multiple medical conditions would stop his promising career in its tracks. Chronic pain in his back and arms and complications caused by herniated discs, labral tears, and myofascial myalgia all made it impossible to keep working without jeopardizing his health.
When he filed for long-term disability benefits, Lincoln rejected his claim, so he came to Dabdoub Law Firm for help. In that case, we were able to appeal the denial and secure the benefits that he needed. Yet it seems that Lincoln was not done with the case and wanted to spar with our award-winning and nationally-recognized attorneys again because the insurance company unreasonably terminated those same benefits early, which prompted him to come back to us for more help.
Upon review of the early termination notice, Attorney Burgos found that Lincoln had reasoned itself into an impossible position. Based on one set of medical evidence, it had somehow determined that our client was too disabled to work his prior sedentary occupation as a software engineer but was also not disabled enough to stop him from working a different sedentary occupation in IT. How can both options be true?
Not willing to lose time arguing with Lincoln about its paradoxical stance, Attorney Burgos turned to objective medical evidence of our client’s disability. Records from various medical providers throughout the years noted that he was “ineligible for full-time employment in any sedentary occupation” because he would suffer “severe pain from cervical motions performed for desk type work”, among other serious issues that left him too disabled to work. Lastly, the case was backed up by an independent medical evaluation (IME) from late 2024 that produced results reflective of what his other treating physicians had already determined.
At the risk of going head-to-head with our legal champions of Dabdoub Law Firm, Lincoln conceded. Our client is once again receiving the LTD benefits he is owed. We will remain ready to stand up for him again if the time comes again, of course.
