Own Occupation & Any Occupation Disability
As lawyers ourselves, we know how strenuous an average day at the office can be. You need to stay on the move to meet with clients, research a case, and get to the courtroom, and so on. Standing or sitting for long periods of time are not uncommon, as you certainly know as well. The dexterity of a lawyer’s hands is also crucial since we spend so much time typing up case information, emails, etc. Any injury or illness that interferes with your job-related abilities might be grounds for disability benefits to some extent.
The two primary categorizations for disability benefits are:
- Own occupation: In most cases and under most disability insurance policies, you will initially file for “own occupation” disability benefits. Put simply, you are claiming your injury or illness prevents you from comfortably completing tasks related to your own occupation, to being a lawyer. Own occupation disability generally expires after 24 months, unless you have what is known as an “own occupation” disability policy.
- Any occupation: When your own occupation disability benefits end after 24 months, you must prove you are unable to complete job duties for any occupation in order to continue receiving benefits, in most cases. This means the disability insurance company will again investigate your claim to determine if you meet this new, more stringent definition of disability.
Investigations into Your Disability Claims
Any insurance provider, whether one that is part of an ERISA group or an individuals disability insurance,, will conduct an investigation into your claim for disability benefits as a lawyer. Investigations will look into a typical day in your law office, as the specifics of your occupation as an attorney, and the extensiveness of your injuries or illnesses. Medical records, office records, testimonies from trusted parties, and other key sources can all be used to prove the validity of your disability claim. Insurance companies may also seek to delve into your personal and business finances, even if not required to prove your disability.
Our long-term disability attorneys can assist you before, during, and after the investigation of your disability claim to improve your chances of case success.
