MetLife Disability Claims

Disability Insurance Attorneys Serving Clients Across the Country

MetLife disability claims are filed every day. It is a very common long-term disability insurance carrier.

Our disability insurance attorneys have handled numerous cases with MetLife. We have successfully filed appeals to get our clients’ disability benefits back and have litigated numerous cases against this disability insurance company in federal court.

If you received your disability benefits through a policy at work, your claim is most likely governed by a federal law called the Employee Retirement Income Security Act (ERISA). If it applies to your case, you likely need to complete an appeal if your benefits get denied or terminated.

In every ERISA case, it is critical that you include your medical records and supportive information from your doctors with your appeal. There are also specific concerns you should look out for when filing a MetLife disability claim. Because we have handled so many cases against them, we know what to expect.

Our Experience with MetLife Disability Claims

In recent years, we have seen a trend where MetLife disability attempts to delay making claims decisions. This strategy extends the period of time that a person has to continue paying daily expenses without receiving their monthly disability benefit checks.

Many people tire from the process and give up. Others wait so long for disability benefits that any settlement offer seems like a good deal.

ERISA has specific guidelines that prohibit this type of delay. Under ERISA, an insurance company has 45 days to make an initial claim decision. Once you file an appeal, they have 45 days to make a decision. After the first 45-day period, they can take one 45-day extension. The extension period must begin at the end of the initial 45-day period.

Our attorneys have seen MetLife disability use some creative counting methods. In one case, they informed our client that it had reached the end of its 45-day period and would be taking its 45-day extension period. But they would not begin counting that period until its doctor finished his review. This is not acceptable. An insurance company cannot choose when to start and stop the timer.

ERISA contains protections for people making a claim for disability benefits. But it can be difficult to understand. Unfortunately, disability insurance companies will use this to their advantage every chance they get.
