This is due to the fact that they had “discretion.” This meant that a federal judge could not rule in favor of the claimant unless the insurance company acted completely unreasonably in denying benefits.

Michigan put an end to this insurance friendly rule. In 2007, Michigan banned discretion in disability insurance products. Effective February 2007, this ban applies to any insurance policy issued, advertised, or delivered to any person in Michigan.
