Oregon Disability Lawyer

Our disability lawyers are able to file lawsuits in the state of Oregon. Most disability claims fall under a federal law called the Employee Retirement Income Security Act (ERISA). This law governs private disability coverage offered by private employers. If you receive coverage through your job, your claim likely falls under ERISA. Most lawsuits in Oregon for disability benefits are filed in federal court.

ERISA sets forth strict deadlines. It is important you meet these deadlines. Failure to adhere to a deadline may result in the ban of all disability benefits. It is important you hire an attorney who is familiar with ERISA.

Our firm has helped many individuals with claims for benefits in the state of Oregon. Our attorneys have vast experience with ERISA and long-term disability claims. We have dealt with all major disability insurance companies. These include Cigna, Unum, Aetna, Metlife, Reliance, Hartford, Prudential, Lincoln, Liberty Mutual, and many more. Our goal is to help people receive the benefits they deserve.

How Are Oregon’s Laws Favorable To Disabled Individuals?

Oregon’s laws are some of the more favorable for disabled individuals. Up until 2015, insurance companies in Oregon enjoyed an unfair advantage in ERISA disability cases. This is because they had “discretion” to make decisions as to disability. This made it difficult for a judge to rule in favor of the disabled. The insurance companies were granted deference. In order to rule in favor of the claimant a judge must rule the insurance company acted completely unreasonably in denying benefits.

This was a harsh standard to meet. It was not enough for a judge to find the individual was disabled. Indeed, a judge needed to find that there was no reason for the denial of benefits.

In 2015, Oregon passed a law banning discretion. As such, any policy issued after March 12, 2015, could not contain a discretionary clause. This means judges need not afford discretion to insurance companies. This leads to many more rulings in favor of insured people.
