This was a harsh standard to meet. It was not enough for a judge to find the individual was disabled. Indeed, a judge needed to find that there was no reason for the denial of benefits.

In 2015, Oregon passed a law banning discretion. As such, any policy issued after March 12, 2015, could not contain a discretionary clause. This means judges need not afford discretion to insurance companies. This leads to many more rulings in favor of insured people.
